Seriously though, since everything I know about the law I learned from Matlock reruns, how much protection do terms of service like those actually offer? If someone from Rakofsky et al went ahead with a suit against that sight for whatever reason, how much water would that boilerplate actually hold with the court?

Well, it's not difficult to access (indeed, linked to right at the start of the article makes it pretty up-front), it's written in relatively plain language, there's no purchase or lease involved so a salience argument would probably be moot, there's no social pressure to accept them, and there's no real inequality of power being exploited, so I'd say that the terms of service have a pretty good shot at being upheld. Indeed, it would probably require Rakosfky-level legal incompetence to challenge them as unconscionable or even unreasonable.

After all this is said and done, would you be a mentor to Rakofsky? I'm sensing Oscar movie material here. A remake/reimaging of the Odd Couple tv series. There could be mucho dinero to be made as well as redeeming a lost lolyer.

If I was in charge of the Touro Law School, the place where Joseph Rakofsky got his law degree, I'd offer to pay back Rakofsky's tuition if he promised to never have anything to do with the law ever again.
