This should be a very, very interesting case to follow for all of us who want to keep online backups on other than our own hardware...pretty much, the entire 'cloud' infrastructure's viability as a business depends on this guy getting his data back.
Hilarious that thus far, they've found just one "innocent" Megauploader user. But he absolutely should get his video returned.
It's just digital information, it's not like the goverment is taking his data away from him.

I'm sure there's more, but vetting each one who claims to be innocent for -any- "illicit" activity has got to take a while. It wouldn't do for your 'face' to have a skeleton in his closet, after all.

Nice try. Making a digital copy of something is not stealing. Taking away the only digital rendering of something is stealing.

The government often takes the property of those involved (knowingly or not) in illicit or illegal ventures.
Not saying it's right. Just that there's precedent.

I would--see my first post above.
The 'cloud' thing depends on the clients for the services having some assurance that they will have access to their data on demand. If other users on the same service could potentially cause seizure of their data by the US government, then no business in their right mind will want to use a 'cloud' service for anything that might be business-critical.
We're talking an industry that in China already exceeds $1bn in investment; it'd be a huge driver for the US economy if the US were to take steps to ensure client data could be adequately safeguarded.

I refuse to put anything important on any sort of cloud backup. I don't think it's secure enough for trade secrets, and then this megaupload thing, it can be seized.
Once seized you might never get it back, or worse, it may be made public.

Personally, I think that shotgunning important things in encrypted archives with non-obvious labels (English_Essay_Ezra_Pound_Backup_$DATE --who's going to want to decrypt -that-?) is adequate for most people, but it's hardly a reasonable strategy for a business.

I do, typically, but it's depressing when every thread he's in devolves to the same damn story every damn time. You could write a five-line python script to recreate every damn thread.
Local + offsite is according to best practices. A strongly encrypted g-drive or similar is adequate for a secondary backup in most cases, but given the current state of data seizure, it's probably best to distribute it in two or three places--and even then, only a limited subset of data.
If you had a friendly company not in direct competition, it might be useful for you to make an agreement to provide offsite storage for encrypted business archives with each other, but that's something that'd require contracts and suchlike to negotiate.

So yes, they should be allowed to get their data if they pay for the labor to get the files to him.
He had two copies. His hard drive failed about the same time the Megaupload servers were seized.
osirisothedead: I'm not sure we need yet another reference to a thread where you were consistently wrong. There's already a whole plethora of them.
Then why dsd you say It's not stealing if you think It's stealing now?

Making a digital copy of something that doesn't prevent the original copy from being accessible is not stealing. My stance has not changed. Making the only copy unavailable to its rightful owner is stealing.
If you don't know the difference, please go take a remedial English class.

quinblake: What if it's a linux distro?
What it is what we are talking about and not something completely different?

osirisothedead: Really? Go get a copy, then.
Who is the rightful owner?
That guy needs to prove he owns it and pay for the retrieval.

A linux distro is "a digital file".

Oh. So if the government snatches your car from a parking space you've paid for, you should have to pay the government to get it back. I see. Good going, flash.

osirisothedead: I'm using a metaphor to illustrate how dumb you're being.
I'm just using your argument against you :/

quinblake: Oh look at our little flashy, he can name a linux distribution.
He won't say "Ubuntu", it implies darkies.

youralt: I refuse to put anything important on any sort of cloud backup. I don't think it's secure enough for trade secrets, and then this megaupload thing, it can be seized.
You might be interested in SpiderOak. No passwords ever cross the wire, and they couldn't make your data public even if they wanted to (or a court ordered them to).

She said any linux distro.
Red Hat isn't free.

And that makes it totally impossible to download it as a digital file?

Well, quick1 was asking about downloading Linux distros.
You said "Red Hat" and said it isn't free.
Um, so?

osirisothedead: Sorry, quinblake.
I get you two confused. You both have big knockers.
My big knocker is singular.

when you steal something you:
1. get use of a service, good, or resource without agreed upon payment against the will of the distributor or owner
2. prevent someone who is the owner, distributor or some agent of theirs from using that service, good, or resource.
What is kind of interesting here is that when people download songs illegally, they are engaging in 1, but not 2. But the government here is engaging in 2, but not (intentionally) 1. Neither is completely meeting the definition of stealing but both have reasonable downsides and moral dilemmas attached.

the cloud is fucked.
I believe it was flashlv who introduced the term "stealing" in this thread as though other bNers war accusing the government of doing so.
osirisothedead: And that makes it totally impossible to download it as a digital file?
This proves that he's against distribution of digital wares on the internet, legal or otherwise.

Red Hat isn't free.
CentOS is basically a direct copy of RedHat Enterprise Linux. So, would downloading CentOS be considered piracy in your boom?

Boom = book.
flashlv: It's just a digital copy.
That the fucking owner NO LONGER HAS ACCESS TO.
Damn you're dumb.

And when you dl a movie, Spielberg no longer as access to that movie anymore.
It's completely the same, don't you see!?!
